Limited Warranty

The John McCluen Company, hereafter referred to as “Seller”, warrants it’s flotation devices to the original owner hereafter referred to as “Purchaser”, against sinking, becoming waterlogged, cracking, peeling, fragmenting or losing beads under normal service for a period of ten (10) years in accordance with 36CFR327.30 APPENDIX C. 

The Sellers liability hereunder in any case is expressly limited to replacement of the defective flotation device. The Purchaser will provide Seller with an opportunity to inspect and test any flotation device claimed to be defective. 

In no event will the Seller be liable for any defective flotation device if examination reveals that the defective condition is attributed to misuse, negligence, alteration, accident, improper installation or maintenance, improper repair or act of God. 

The Seller makes no representation or warranty of any kind, express or implied, with respect to the products sold hereunder as to merchantability, fitness of purpose, or legality of use in any jurisdiction. The Seller will not be liable for any loss of use, costs or fees or any liability for direct, or indirect, or consequential damages or delays. No other person, firm or corporation can bind Seller to any warranty other than herein stated.
